1. Acceptance of Terms

By accessing or using Eyes On It Ltd’s services, you agree to be bound by these Terms of Service. If you do not agree to these terms, you may not access or use our services.

“Service” refers to the Eyes On It tracking platform and related services.
“User” means any individual or entity accessing the Service.
“Customer” means a paying subscriber to our Service.
“Device” refers to hardware used for tracking assets.

3. Services Description

Eyes On It provides a real-time asset tracking platform for vehicles, containers, and personnel. Features include live mapping, geofencing, driver safety scoring, and maintenance scheduling.

4. User Accounts

To use the Service, you must:

Register for an account with accurate information
Maintain the security of your account credentials
Be at least 18 years old
Have legal authority to track any assets registered in the system

5. Acceptable Use

You agree not to:

Use the Service for any illegal purpose
Track vehicles or assets without proper authorisation
Attempt to gain unauthorised access to the Service
Interfere with other users’ use of the Service
Upload malicious software or data

6. Data and Privacy

Your use of the Service is subject to our Privacy Policy. You are responsible for ensuring you have proper consent to track any individuals or assets using our Service.

7. Intellectual Property

All content, software, and technology comprising the Service are owned by Eyes On It Ltd and protected by UK and international intellectual property laws.

8. Payment Terms

For paying Customers:

Fees are charged monthly in advance
Payment is due by direct debit or credit card
Late payments may result in service suspension
VAT is charged at the applicable rate

9. Service Level Agreement

We aim to maintain 99.5% uptime for our Service. Scheduled maintenance will be communicated in advance. Force majeure events are excluded from uptime calculations.

10. Termination

Either party may terminate the Service with 30 days’ written notice. We may terminate immediately for breach of these terms. Upon termination, your data will be retained per our Privacy Policy before secure deletion.

11. Limitation of Liability

To the extent permitted by law, Eyes On It Ltd’s total liability shall not exceed the amount paid by you in the 12 months preceding the claim. We are not liable for indirect, consequential, or punitive damages.

12. Indemnification

You agree to indemnify Eyes On It Ltd against claims arising from your use of the Service, violation of these terms, or infringement of third-party rights.

13. Governing Law

These Terms are governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.

14. Changes to Terms

We may modify these terms at any time. Significant changes will be communicated via email. Continued use constitutes acceptance of revised terms.
